    Description and Objectives: Lights, camera, action!  On December 11, 2021, the Provide Accurate Information Directly (PAID) Act went live!  Signed into law in December 2020, the PAID Act requires the Centers for Medicare and Medicaid Services (CMS) to provide insurers (including self-insurers) with key information regarding a claimant’s Medicare Part C (Medicare Advantage) and Medicare Part D (Prescription Drugs) enrollment status.  With Medicare Advantage recovery claims and lawsuits on the rise, the PAID Act provides insurers with critical  information to proactively address Medicare Advantage and Part D recovery claims to avoid liability if they so elect.

    This session will break down the PAID Act hitting on the following key topics:

    • What is the PAID Act’s objectives?
    • What information will CMS be providing insurers?
    • How can insurers take advantage of the PAID Act data?
    • Medicare Advantage and Part D recovery rights

    Mark Popolizio is the Vice President of MSP Compliance and Policy for ISO Claims Partners. He is a nationally recognized authority in Medicare Secondary Payer (MSP) compliance.

    Mark practiced insurance defense litigation for ten years concentrating in the areas of workers' compensation and general liability. Since 2006, Mark has dedicated his practice exclusively to MSP compliance working with carriers, self-insureds, TPAs, and other claims professionals in addressing MSP compliance issues.

    Mark is a regularly featured presenter on MSP issues at national seminars and other industry events - and has authored numerous national articles addressing several topics related to MSP matters, including a chapter in the California Bar CLE publication, Special Needs Trusts: Planning, Drafting, and Administration. Mark is also active with other industry groups, including MARC, DRI, and NAMSAP.

    Mark graduated Summa Cum Laude from Quinnipiac University in Hamden, Connecticut with a Bachelor of Science degree in Legal Studies and Sociology. He relocated to South Florida in 1992 to attend law school at Nova Southeastern University School of Law in Ft. Lauderdale, Florida. While at law school, Mark served as a Judicial Clerk to the late Honorable John D. Wessel (15th Judicial Circuit, Palm Beach County, Florida) and was a research assistant for Professor Leslie Larkin Cooney. Mark graduated from Nova in 1995 and is licensed to practice law in Florida and Connecticut.

Mollie is originally from Ohio and graduated with a Bachelor's in Education from Washington University and a Master's in counseling from Northwestern University. Mollie started her career as a public school teacher and then moved towards counseling and psychology at a Master’s Degree level. Her introduction to worker’s compensation was providing group and individual counseling to injured workers and their families in the private clinical sector. Mollie transitioned to Corvel as a senior case manager for 13 years and became noted in her field in South Florida . After working at Genex for one year, Mollie decided to start her own company as a sole practicing case manager, giving customers the high quality care without higher costs, administrative fees and incentivizations that she had known in prior companies. Mollie formed MKCM ( Mollie Kallen Case Management, Inc.) emphasizing strong customer service, transparency, ethics, quality and using only experienced case managers. Ms. Smith went on to practice as a shareholder at a top Pittsburgh law firm serving as Vice-Chair of the Medicare Compliance Group. She concentrated her practice in the area of Medicare compliance as well as workers compensation litigation, medical malpractice, and general insurance defense. Ms. Smith also served as a Medicare compliance attorney and shareholder for a national defense firm and worked as in-house counsel for a leading Pittsburgh health facility. Ms. Smith was selected for inclusion in the Pennsylvania Rising Stars list of outstanding young attorneys in 2008 and has been listed in Best Lawyers since 2011 in the area of workers compensation. Ms. Smith is involved in various charitable organizations and serves as a volunteer faculty advisor for a local high school trial advocacy team. Ms. Smith is licensed to practice law in Pennsylvania and West Virginia. In her role as VP of Compliance and Customer Relations, Ms. Smith utilizes her extensive compliance, litigation, and workers compensation experience to provide customers guidance on Medicare Secondary Payer (MSP) issues .     Jennifer has been with the NuQuest (and formerly Protocols) since 2010.  Prior to joining Protocols, she spent over ten years at a large national insurer working with both workers compensation and liability claims teams. He simultaneously served as president of Claims Management, Inc.,Walmart’s wholly owned third party administrator. An attorney by trade, Kooncewas previously an administrative law judge for the Arkansas Workers’Compensation Commission and an appellate court justice for the Arkansas Courtof Appeals. Koonce has served on various state self-insured association boards,as well as the National Council of Self Insurers (NCSI), and NationalUnemployment and Workers’ Compensation (UWC). He continues to serve as a memberof several local non-profit boards and industry risk management advisoryboards.     John Logue

    Ohio Bureau of Workers' Compensation

    John Logue joined the Ohio Bureau of Workers' Compensation as Chief of Strategic Direction in April 2019. He became Interim Administrator/CEO on Nov. 16, 2020, after Gov. Mike DeWine named his predecessor, Stephanie McCloud, director of the Ohio Department of Health. John is a veteran of the Ohio workers' compensation system, with a background that includes more than 25 years of experience in various client service and leadership roles. He most recently served as a vice president at Sedgwick Claims Management Services. John began his career as an employer services specialist at BWC before serving in a variety of roles with Ohio managed care organizations and third-party administration organizations. John is active in his community and is a member of the Westerville Sunrise Rotary Club. He earned a bachelor's degree in economics from John Carroll University, a master's in business administration from Cleveland State University, and earned an Associate in Risk Management designation from the Insurance Institute of America, known today as The Institutes.

    Jim Hughes

    Ohio Industrial Commission

    Jim Hughes was appointed by Governor Mike DeWine to be the chairman and employee member of the Ohio Industrial Commission for a term that began on July 1, 2019. Jim brings decades of legal knowledge and public policy experience to his role as chairman. He began his career as a bailiff and court constable in the Franklin County Court of Common Pleas. He later served as assistant prosecutor in the City of Columbus Prosecutor's Office and then as assistant prosecutor for Franklin County. He also worked previously as an attorney and partner at the Isaac Wiles law firm in Columbus. In 2000, he was appointed to the Ohio House of Representatives and was later elected to the Ohio Senate in 2008. During his 18 years in the Ohio General Assembly, Jim supported legislation that toughened criminal penalties, protected children, reformed taxes, streamlined regulations, and incentivized businesses to settle in Ohio. He also served on many legislative committees including Civil Justice, Insurance and Financial Institutions, Energy and Public Utilities, Transportation and Public Safety, and Criminal Justice. Jim has received numerous accolades from several groups over the course of his career. He has been named Legislator of the Year by the FOP Capitol City Lodge No. 9, the Ohio Fire Chief’s Association, the Ohio Nurses Association, the Ohio Association of Professional Firefighters and the AMVETS Department of Ohio. In addition, he has received the Ohio Association for Justice Workers Compensation Outstanding Service Award, and the Watchdog of the Treasury Award, among others. Jim earned his Juris Doctorate at Capital University Law School after completing his bachelor’s degree in business administration at The Ohio State University.

     

    David Boyd

    David Boyd has more than 25 years’ experience in the insurance industry, serving for 14 years at Ohio BWC and 10-plus years working for a third-party administrator as a senior account executive and risk consultant. David is currently the Director of Self-Insured Operations at BWC, a position he held from 2005-2008. In his role as Director, David oversees 1,140 self-insuring employers that he and his staff ensure are adhering to underwriting, financial and claim administration requirements, among other duties. David holds a bachelor’s degree in business administration with a focus in finance from The Ohio State University.

    William S. Marras

    Director of the Spine Research Institute

    William S. Marras holds the Honda Chair in the Department of Integrated Systems Engineering at the Ohio State University and serves as the Director of the Spine Research Institute at the Ohio State University. Dr. Marras holds joint academic appointments in the Department of Orthopaedic Surgery, the Department of Neurosurgery, and the Department of Physical Medicine & Rehabilitation. He is also a board certified ergonomist. His research is centered on understanding multidimensional causal pathways for spine disorders through quantitative epidemiologic evaluations, laboratory biomechanical studies, personalized mathematical modeling, and clinical studies of the lumbar and cervical spine.  His findings have been published in over 250 peer-reviewed journal articles, hundreds of refereed proceedings, and numerous books and book chapters including a book entitled “The Working Back: A Systems View.” He holds Fellow status in six professional societies including the American Society for the Advancement of Science (AAAS) and has been widely recognized for his contributions through numerous national and international awards including two Volvo Awards for Low Back Pain Research and an honorary Sc.D. degree. In 2017 he was awarded Distinguished Scholar designation at the Ohio State University. Professor Marras has been active in the National Research Council (NRC) having served on over a dozen boards and committees and has served as Chair of the Board on Human Systems Integration for multiple terms. He has also served as Editor-in-Chief of Human Factors and is currently Deputy Editor of Spine and is the past President of the Human Factors and Ergonomics Society (the world’s largest such society). Dr. Marras is an elected member of the National Academy of Engineering (the National Academy of Science, Engineering and Medicine), recorded a TEDx talk entitled “Back Pain and your Brain” and has been featured on NPR’s All Things Considered.

    Day 2, Session 6 of the 2021 OSIA Virtual Annual Conference

    From Reefer Madness to Cheech & Chong, marijuana as occupied a unique space in American culture, being both vilified and celebrated for years.  Now, more quickly than many expected, marijuana has gone mainstream.  With more and more states legalizing marijuana for medical use, or increasingly for recreational use, employers must be prepared to deal with changing attitudes, laws, and impacts of this drug in the workplace.


    Shane M. Dawson, Esq, is a partner in the Columbus office of the national law firm of Dinsmore & Shohl, LLP.  At Dinsmore, he focuses his practice on representing employers in workers’ compensation claims as well as related employment law matters.  Prior to joining Dinsmore, Shane managed his own firm for more than 12 years.  Now in practice as an attorney for over 23 years, his first lessons in Ohio workers’ compensation were as a criminal investigator and fraud analyst for the Ohio Bureau of Workers’ Compensation while working through law school.  Shane received his Bachelor of Science in Business Administration from the Fisher College of Business at The Ohio State University in 1992 and earned his law degree from Capital University Law School in 1996.

    “There is nothing more horrifying than stupidity in action."

    This quote, attributed to Adlai Stevenson, is particularly true when an employer must pay for it.  As a no fault system, Workers’ Compensation compensates claimants despite their own negligence and outright stupidity. In this session, we will look at various fact situations where ridiculous behavior was compensable, and perhaps find a scenario where a claimant’s actions were so outrageous as to provide a defense.

    Randall W. Mikes is an attorney with Kegler Brown Hill + Ritter, practicing in the areas of workers’ compensation and litigation. With 30 years of workers’ compensation experience, Randy represents Ohio employers at administrative hearings before the Industrial Commission and before the Bureau of Workers’ Compensation, and defends them in matters in Ohio’s courts of common pleas, courts of appeal, and Supreme Court. He is recognized in Best Lawyers and is a member of the Columbus Bar Association’s Workers' Compensation Committee.

Mr. Gibney is a frequent lecturer on the Affordable Care Act, National Labor Relations Act (NLRA), Occupational Safety and Health Act, Family and Medical Leave Act (FMLA), civil rights legislation and workers' compensation laws. His administrative practice includes regularly appearing before the NLRB, OSHA, Industrial Commission of Ohio and various federal, state and local civil rights agencies. Mr. Gibney also regularly counsels employers on ways to prevent such litigation.

    Anne K. Schmidlin assists clients with their legal needs including noncompete agreements, severance packages, wage and hour matters, employment handbooks and employment discrimination charges. Her practice involves representing employers before the EEOC and other administrative agencies.

Her knowledge in Cyber Security has earned her international speaking engagements and panel opportunities. Lacy is actively engaged with insurance carriers to craft and create new coverages and manuscript forms.  She integrates her product and market knowledge to find solutions for client’s issues that arise daily. Lacy works closely with insurance companies to draft policy enhancements, providing innovative solutions to local, national and international companies. The pace of Cyber incidents continues to soar allowing Lacy to be on the forefront of protecting clients’ largest and most valuable assets. Lacy earned her degree in History with a minor in Art History from Indiana University.
