Burning Shield - The Jason Schechterle Story

Jason’s journey chronicles his fight for life, his triumph over tragedy and the inspiration that enables him to continue to overcome unimaginable adversity. His personal narrative exemplifies that the power of the human spirit can never be underestimated or extinguished. Growing up, Jason had one dream - to serve as a Phoenix Police Officer.  Inspired by his brother and the tragic loss of a local law enforcement hero, Jason worked persistently towards his dream. After serving four years in the Air Force, at the age 26, Jason achieved his goal to work on the streets of Phoenix as a rookie police officer.  Then, only 14 months into what was supposed to be a life-long career, Jason's life took an unexpected, dramatic and, at the time, tragic turn. On the night of March 26th, 2001, a taxi cab crashed into the rear of Jason's patrol car.  Upon impact, Jason's car burst into flames, trapping him inside with temperatures reaching over 700 degrees. Through a series of miraculous and fateful circumstances, Jason survived the crash and ensuing physical and emotional catastrophe.  He suffered severe burns to over 40% of his body which drastically altered his appearance. He has undergone more than 50 surgeries just to have the ability to accomplish simple daily tasks we often take for granted.

This session will describe the history of PTSD.  Changes in PTSD from the DSM-IV to the DSM-5 will be discussed.  Case histories considering the presence or absence of PTSD will be presented.  There will be a discussion of the law pertinent to PTSD with regard to medical versus situational/environmental factors.

Workers' Compensation subrogation is based on the premise that a party who causes an injury should bear the cost of the injury and the injured worker should not recover twice for the same injury. Mr. Garvin will review the subrogation law, formula and relevant court cases. He will discuss the use of subrogation in the settlement of claims and the unusual position an employer can find themselves if the subrogation matter is pending in court.

“There is nothing more horrifying than stupidity in action.”
 
This quote, attributed to Adlai Stevenson, is particularly true when an employer must pay for it.  As a no fault system, Workers’ Compensation compensates claimants despite their own negligence and outright stupidity. In this session, we will look at various fact situations where ridiculous behavior was compensable, and perhaps find a scenario where a claimant’s actions were so outrageous as to provide a defense.

Marijuana Goes Mainstream
Shane M. Dawson, Esq.

From Reefer Madness to Cheech & Chong, marijuana as occupied a unique space in American culture, being both vilified and celebrated for years.  Now, more quickly than many expected, marijuana has gone mainstream.  With more and more states legalizing marijuana for medical use, or increasingly for recreational use, employers must be prepared to deal with changing attitudes, laws, and impacts of this drug in the workplace.

Andy Cassady is an associate attorney at Dinsmore & Shohl LLP in Cincinnati where he focuses his practice on commercial litigation and business disputes. His extensive litigation experience enables him to be a strong and aggressive advocate at every stage of a case. That experience spans the gamut: pre-litigation counseling; comprehensive legal research; reviewing documents; using his writing skills in drafting briefs, pleadings, and motions; managing the discovery process; deposing adverse parties and witnesses; representing clients at trial; and appellate argument.

Shane M. Dawson, Esq, is a partner in the Columbus office of the national law firm of Dinsmore & Shohl, LLP.  At Dinsmore, he focuses his practice on representing employers in workers’ compensation claims as well as related employment law matters.  Prior to joining Dinsmore, Shane managed his own firm for more than 12 years.  Now in practice as an attorney for over 23 years, his first lessons in Ohio workers’ compensation were as a criminal investigator and fraud analyst for the Ohio Bureau of Workers’ Compensation while working through law school.  Shane received his Bachelor of Science in Business Administration from the Fisher College of Business at The Ohio State University in 1992 and earned his law degree from Capital University Law School in 1996. 

Denise Evans is currently the Corporate Workers’ Compensation Director of Claims with Staffmark Group. Denise has been with Staffmark for 30 years and has over 29 years of claims management experience.  She has attended and spoken at numerous workers’ compensation seminars throughout the United States. Denise was also featured in a Property Casualty 360 issue featuring successful workers’ compensation programs and Business Insurance. Denise is responsible for claims management for Staffmark Group, throughout the United States, including the National Insured Program and the Ohio Self-Insured self- administrated program.  She also provides internal support by conducting workers’ compensation training for Staffmark employees and assisting with incident investigations for the Staffmark Group’s Risk Management and Safety departments.

Preston J. Garvin began his workers' compensation career as a Hearing Officer for the Industrial Commission. He served as Legal Director, Chief Legal Advisor, to the Industrial Commission. In 1997, Preston and Michael Hickey formed the law firm of Garvin & Hickey, LLC. Preston is Special Counsel to the Ohio Chamber of Commerce for workers' compensation matters and Chairman of the Workers' Compensation Committee. He has testified before various House and Senate committees on numerous workers' compensation bills. He has participated in numerous Amici Curiae briefs before the Ohio Supreme Court. Preston has served on various Industrial Commission and BWC committees. He presently serves on the Rules Advisory Task Force. 

Hayley Geiler is an associate attorney at Dinsmore & Shohl LLP in Cincinnati where she works with clients of all sizes across multiple industries. Her practice focuses on the Fair Labor Standards Act, Family Medical Leave Act, the Americans with Disabilities Act, the Age Discrimination in Employment Act, Title VII of the Civil Rights Act of 1964, the Ohio Civil Rights Act, wrongful termination, and restrictive covenants.

Thomas J. Gibney concentrates his practice in the areas of human resources management in the private and public sectors, employment litigation, private and public sector labor negotiations and contract application, workers' compensation, and federal and state safety regulation litigation.  He is a member of Eastman & Smith. Mr. Gibney is a frequent lecturer on the Affordable Care Act, National Labor Relations Act
(NLRA), Occupational Safety and Health Act, Family and Medical Leave Act (FMLA), civil rights legislation and workers' compensation laws. His
administrative practice includes regularly appearing before the NLRB, OSHA, Industrial Commission of Ohio and various federal, state and local civil rights agencies. Mr. Gibney also regularly counsels employers on ways to prevent such litigation.

Anthony Jagoditz is a partner at the law firm of Dinsmore & Shohl LLP and primarily concentrates his practice on workers' compensation issues. He counsels and collaborates with businesses of all sizes in the management of their workers' compensation programs from initial claim investigation to resolution. T.J. executes client strategies for all administrative hearings before the Industrial Commission of Ohio throughout the state, including issues of claim allowance, temporary total disability compensation, permanent total disability compensation, and medical/treatment issues. He also has significant experience trying cases before various courts of common pleas throughout the state.

Randall W. Mikes is an attorney with Kegler Brown Hill + Ritter, practicing in the areas of workers’ compensation and litigation. With 30 years of workers’ compensation experience, Randy represents Ohio employers at administrative hearings before the Industrial Commission and before the Bureau of Workers’ Compensation, and defends them in matters in Ohio’s courts of common pleas, courts of appeal, and Supreme Court. He is recognized in Best Lawyers and is a member of the Columbus Bar Association’s Workers' Compensation Committee.

Robert A. Minor, Esq. Prior to his retirement on January 1, 2019, Buz Minor was a partner in the Columbus office of Vorys, Sater, Seymour and Pease LLP, and practiced in the area of labor and employment law.  His practice included workers' compensation defense before the agencies and courts, assisting employers in obtaining self-insurance status and in resolving SI compliance issues, participation before the Ohio Supreme Court as amicus curiae, the defense of direct liability actions and employment intentional torts, and OSHA compliance and defense.  Mr. Minor is the Executive Secretary of the Ohio Self-Insurers Association, serves on the Executive Committee of the National Council of Self-Insurers, and is a former President of the National Council.  Mr. Minor is a frequent lecturer before national and state audiences on employer liability law and is recognized in The Best Lawyers in America.  

Michael Murphy, PhD obtained his doctorate degree at The Ohio State University. He is a licensed psychologist and licensed clinical counselor. He is a psychological consultant to state agencies and other professional groups and organizations.

Lacy Rex, AU, has more than 13 years experience in the insurance industry, always focused on executive risk coverages. Her knowledge in Cyber Security has earned her international speaking engagements and panel opportunities. Lacy is actively engaged with insurance carriers to craft and create new coverages and manuscript forms.  She integrates her product and market knowledge to find solutions for client’s issues that arise daily. Lacy works closely with insurance companies to draft policy enhancements, providing innovative solutions to local, national and international companies. The pace of Cyber incidents continues to soar allowing Lacy to be on the forefront of protecting clients’ largest and most valuable assets. Lacy earned her degree in History with a minor in Art History from Indiana University.

OSIA will host a Silent Auction to benefit Kids’ Chance of Ohio, a charitable organization that raises scholarship money for children whose parents have been killed or seriously injured in work-related accidents. Gift items may be bid on during the Virtual Conference with announcement of winners made on Thursday, June 17 during the 11:30 am break. 

All proceeds will be donated to Kids’ Chance of Ohio. Credit cards are the preferred form of payment.

OSIA raised more than $6000.00 at the 2019 Silent Auction and is hoping you will help us by raising even more this year. We cannot achieve this goal without donated items to auction. Remember all donated items are tax-deductible!

Once the conference live version is held, you may access available sessions on-demand as well at your convenience at no additional cost. FAQs

How do I move around the room?

Click anywhere in the room with your mouse and keep holding - and here we go, your avatar will make his first steps. 

How do I chat to other guests?

If you want to join a conversation, just move close enough to the group until your avatar stands within the color circle. You can also use written chat from anywhere in the room to communicate with individual guests, your current group or the whole room.

Can I turn off video and audio?

You can turn off your video by clicking on the camera icon at the bottom of your screen. Other guests will see a black screen with your avatar picture when you are part of their conversation. You can turn off your audio by clicking on the microphone icon at the bottom of the room. Other guests will not be able to hear you until you unmute.

Can I write messages to other guests in the room?

Wonder has a chat feature that you can open by clicking on the speech bubble icon. You can send direct private messages to other guests (Private), messages to all guests in your current circle (Circle) or else send a message to the whole room (Everyone).

How do I know who is listening to my conversation?

Only guests who are standing in the circle right next to you can participate in your conversation, so you can see who you are speaking to. There is no way for guests to be hidden, so you always see their avatar, hear them and see their screen. You can also always see all guests who are currently in the room.

What data do you store?

Wonder does not have access to any of your audio or video data. We briefly hold the data to transmit it, but do not store it, and our employees cannot access it. Wonder also doesn’t have any personified data on its guests (e.g. addresses or bank details) because we don’t ask for them. If you request your own room, we ask for your email to send it to you. We store your profile picture, name, and chat so that your information doesn’t get lost between sessions.
